If you own a 2008, 2009, or 2010 Nissan Sentra, Versa, Versa, Note, Altima, Rogue, Cube or Murano, your vehicle may be equipped with a “CVT” type of automatic transmission. In some vehicles equipped with a “CVT” transmission, owners may experience transmission issues that may include: loss of power, improper shifting, no engagement into gear, engine revving up but no power, shudder, shaking or vibration from transmission, “CHECK ENGINE” warning light, “MIL” warning light, “CVT Error” warning light, engine stalling and more. Numerous consumers who have called our law firm have had software updates/reprogramming done to their vehicle, replacement of the Transmission Control Module, and even complete CVT transmission replacement(s). Many owners call us with no permanent fix every being done for their Nissan! This is not a class-action.

Under the California Lemon Law, if your vehicle has been in the Nissan dealers shop 2 or more times (documented) for any of the problems/symptoms listed BEFORE the expiration of the Nissan 60,000 mile factory warranty and 10 year/120,000 mile Nissan CVT warranty extension* - whether it is currently fixed or not – you may be entitled to receive thousands of dollars in compensation, or a "buy back" of your 2008 - 2010 Nissan w/CVT transmission. Your vehicle may currently have 100,000, 120,00 miles or more -that’s OK. What’s important is what happened while the vehicle was IN-warranty.

NOTE: Under California Lemon Law, all attorney’s fees on lemon law claims are required to be paid to the attorney by the automobile manufacturer – not the consumer. To protect yourself as a consumer, you will want to get as many documented warranty repair attempt visits that you can before the vehicle is out of its CVT transmission factory warranty. 2008 model year Murano and Cube vehicles are not part of 10 year/120,000 mile warranty extension program and we do not pursue claims on these year/models.

PROBLEMS: Many Nisan models sold as 2008-2010 model-years saw these as the most predominant problems and/or failures, when equipped with the CVT (Continuously Variable Transmission), which is based upon a “variable pitch belt” drive:

  • Loss of power
  • CVT coolant hose leaks/failure
  • “CVT Error” message in instrument cluster display.
  • Transmission jerking.
  • Tachometer/engine revving-up yet loss of power.
  • Engine “CHECK ENGINE” warning light illumination.
  • Transmission shifting issues (harsh, bump, slam, delay)
  • Transmission slipping
  • Air Conditioning/engine cooling system problems due to transmission oil overheating.
  • “MIL” warning light on instrument cluster.
  • Delayed, or non-engagement into “Drive” or “Reverse”
  • Overall loss of performance including reduced fuel mileage.
  • Transmission oil leaks.
  • Odor/smell of burning transmission oil
  • Improper transmission down-shifting
  • Improper transmission up-shifting.
  • Harsh/bumping/banging downshifts.
  • Transmission shuddering.
  • Drop-out of power when pressing gas pedal to downshift.
  • Negative performance changes after dealer performs TSB’s and software updates/uploads.
  • Transmission “judder”.
  • Radiator failure and coolant pipe replacement in repair history.
  • Uneven power transmission.
  • Vehicle/Transmission “hesitates” on acceleration.
  • Our law firm has seen remanufactured CVT transmissions delivered and stacked up in Nissan Service Department receiving areas. Here’s an example of a Nissan Altima already having the transmission replaced at only little over 43,000 miles!

It is important to know that Nissan North America produces some of the most high quality, reliable vehicles sold in today's North American market.
